International Privacy and Consent
By submitting your personal information to us, you are consenting to the processing of your personal information in the United States.
Kipsu is located in the United States and primarily stores and processes the data related to the Service in the United States. To facilitate Kipsu’s global operations and comply with local laws, Kipsu may transfer, process and store the data of clients located outside the United States at facilities located in the country where the client is located or at regional facilities. Kipsu may also access and transfer the data in the facilities outside the United States for processing within the United States. If you are outside the United States, any personal data processed by Kipsu may therefore be transferred to, processed and stored in a country outside of the country where you live.
If you are not located in the United States, your local privacy laws may give you certain rights to access information held about you and you may have the right to ask us not to process your personal data for marketing purposes by emailing us at firstname.lastname@example.org.
By using the Service, you have consented to this Policy and all amendments and updates, as provided in the English language only.
What do we mean by personal information?
In this policy, personal information means information that identifies or could be used by or on behalf of Kipsu to identify an individual. Except as described in this Policy, Kipsu will not sell any personal information to any third party for the purposes of marketing to our clients or the end users of our services.
Personal information does not include usage data which we define as encoded or anonymized information or aggregated data we collect about a group or category of services, features, clients or end users, all of which does not contain personally identifying information. Usage data helps us understand trends in usage of the service so that we can better consider new features or otherwise tailor the service. In addition to collecting and using usage data ourselves, we may share usage data with third parties, including our clients, partners and service providers, for various purposes, including to help us better understand our end user needs and improve the service. Other than as described in this Policy, we do not share usage data with third parties in a way that would enable them to identify individuals personally.
How does Kipsu collect, use and share personal information?
Information you provide to us
When our clients register to use our service, we ask for personal information such as the name, mobile phone number, passwords and e-mail addresses of client staff authorized to use the services. When end users enroll in our services with our clients, our clients may collect personal information such as end user’s name and mobile phone number.
Kipsu may use the personal information provided by clients and end users to:
- operate the service and tailor the service to our clients’ needs, for billing, identification and authentication,
- contact and communicate with our clients and their end users about the service,
- to generally improve the content and functionality of the service.
Kipsu may share personal information with its third-party service providers (such as its hosting partners and other services that make up the features of Kipsu) to provide the necessary hardware, software, networking, communication, storage, and other services we use to operate the service, communicate with clients and end users, and maintain a high quality service experience. We do not permit our service providers to use the personal information we share for their marketing purposes. Kipsu may also share this information with the owners, subsidiaries, licensees, affiliates, successors, or other related entities of our clients for the purposes of managing the service offering at client sites.
Kipsu gathers certain information automatically from electronic communications with clients and end users and stores it in log files. This information may include internet protocol addresses as well as browser, internet service provider, referring/exit pages, operating system, date/time stamp and click stream data. Occasionally, we may connect personal information to information gathered in our log files, as necessary to improve the service. Otherwise, we generally use this information as we would any usage data, to analyze trends, administer and maintain the service, or track usage of various features within the service.
A cookie is a small software file stored temporarily or placed on a computer’s hard drive. The main purpose of a cookie is to allow a web server to identify a user’s computer and web browser and tailor web pages and/or login information to their preferences. Cookies help us promptly display the information needed to use the capabilities of the service and other information which we consider to be of interest to visitors to the Kipsu websites and users for the service. By gathering and remembering information about website preferences through cookies, we can provide a better web experience. Cookies don’t give us access to the client or end user’s computers, and the information we collect through cookies doesn’t include personal information.
When clients use the service we utilize “session cookies”; these session cookies allow us to uniquely identify your browser while you are logged in and to process your online transactions. Session cookies disappear from your computer when the web browser is closed or computer is turned off. We also use persistent cookies to identify Kipsu clients and make it easier for them to log into and use the service. Persistent cookies remain on computers after the web browser is closed or the computer is turned off.
Similarly, when end users use our live chat service we utilize browser-based web storage to allow a web server to identify an end user’s computer.
Kipsu’s clients use Kipsu to communicate with their customers through Kipsu; these customers are the end users of the service. These communications may be in the form of SMS (short messaging service)/text messaging, web chat, social messaging, over-the-top messaging or other forms of communication. Kipsu collects and stores the content of these messages along with the meta data, such as mobile phone numbers and date time stamps, linked to these interactions.
Kipsu’s clients may also interface Kipsu to other systems to bring additional content into Kipsu to help enhance the communication abilities with end users. This content is dependent upon and specific to the client connecting to Kipsu. For example, clients may interface Kipsu with their property management system or service ticketing system. In these instances, your information may originate with these client systems and will also be governed by their privacy policies.
When does Kipsu disclose personal information?
Client testimonials, comments, reviews and best practices
From time to time, we post client testimonials on the Kipsu web sites or in materials used for training our clients, which may contain personal information. We obtain the client’s consent to post their names along with their content.
How does Kipsu protect personal information?
Kipsu utilizes robust precautions to protect the confidentiality and security of the personal information within the service, by employing technology, physical, and administrative security safeguards, such as firewalls, advanced security measures and carefully-developed security procedures. These technologies, procedures and other measures are used in an effort to ensure that your data is secure and only available to you and to those you authorized to access your data. However, no internet, e-mail or other electronic transmission is ever fully secure or error free, so you should take care in deciding what information is sent through Kipsu.
Hosting and data transfer
We are based in the United States, but, unless we expressly agree otherwise (as agreed in our commercial agreements with our clients), we may host and process data, including personal information, in the United States and in other countries through Kipsu and third parties that we use to operate and manage the service. WHEN YOU ACCESS OR USE THE SERVICE, OR OTHERWISE PROVIDE INFORMATION TO OUR CLIENTS OR US, YOU ARE CONSENTING, ON BEHALF OF YOU OR END-USERS, (AND REPRESENTING THAT YOU HAVE THE AUTHORITY TO PROVIDE SUCH CONSENT) TO THE PROCESSING AND TRANSFER OF INFORMATION IN AND TO THE UNITED STATES AND OTHER COUNTRIES WHICH MAY HAVE DIFFERENT PRIVACY LAWS FROM YOUR OR THEIR COUNTRY OF RESIDENCE.
Client and end user communications
If you are an end user and would like to opt-out of getting communications from Kipsu please contact us at email@example.com or follow the unsubscribe instructions included in the message.
How do I correct my personal information with Kipsu?
Clients may update or change the personal information they have provided Kipsu by logging into the service and providing such additional information or corrections where applicable. If you are an end user and would like to correct, gain access to, or request deletion of information we have collected as “data controllers,” please contact us at privacy@Kipsu.com. We will respond to such queries within 30 business days.
What are Kipsu’s data retention policies?
Kipsu will retain personal information we process on behalf of our clients or collect directly from end users for as long as needed to provide service to our clients, subject to our compliance with this policy and our commercial agreements with specific clients. We may further retain and use this personal information as necessary to comply with our legal obligations, maintain accurate accounting, financial and other operational records, resolve disputes, and enforce our agreements. We have established internal policies for the deletion of personal information from client accounts following termination of a client’s subscription if required by our client agreements.
Does Kipsu collect personal information from children?
Kipsu does not knowingly collect any personal information from children under the age of 13. If you are under the age of 13, please do not submit any personal information through our service. We encourage parents and legal guardians to monitor their children’s internet and mobile phone usage and to help enforce our policy by instructing their children never to provide personal information to our service without their permission. If you have reason to believe that a child under the age of 13 has provided personal information to Kipsu through our service, please contact us, and we will use commercially reasonable efforts to delete that information from our databases.
If we make any material changes to this policy, we will notify you by posting a prominent notice on the Kipsu web site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices. Your continued use of the service constitutes your agreement to be bound by such changes to this policy. Your only remedy, if you do not accept the terms of this policy, is to discontinue use of the service.
Kipsu may assign or transfer this policy, and your user account and related information and data, including any personal information, to any person or entity that acquires the business, stock or assets of, or is merged with Kipsu.
Your California Privacy Rights
California Civil Code § 1798.83 permits users that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us via the information below.
